1. How much notice does a landlord have to give a tenant to vacate the apt?
a) 30-day notice if Tenant has lived at apt. less than 1 year
b) 60-day notice if Tenant has lived at apt. more than 1 year, less than 2 years.
c) 90-day notice if Tenant has lived at apt. more than 2 years.
if I receive a 14-day notice do I have to leave the apt.? No! but if you do leave the landlord cannot take you to court for nonpayment in a landlord/tenant proceedings, s/he must pursue rent owed in Small Claims Court.
(if rent is paid before court date landlord must accept it - ends court case).
2. Can a landlord ever evict a tenant by changing the locks on the apt? Per RPAPL 768, that is an illegal eviction. Only the City Marshall/Sheriff can lock out a tenant only when executing a warrant of eviction signed by a judge.
